O que é sujeito indeterminado?
Aprendemos lá no 6º ano que o sujeito é indeterminado quando o verbo não se refere a uma pessoa determinada (eu, você, o réu, o demandante), seja por se desconhecer quem é a pessoa, seja por desinteresse em saber mesmo.
Mas, neste caso, basicamente o verbo vem na 3ª pessoa do plural, exemplo: “venderam livros”
ou na 3ª do singular com o pronome “se” seguido de preposição, como: “precisa-se de dinheiro”.
Assim, na frase “trata-se de agravo de instrumento” o sujeito é indeterminado: o “trata” está na 3ª pessoa do singular, vem coladinho com o “se”, e há preposição depois (“de”).
Até aqui tudo certo? Podemos continuar?
Pois bem, observem bem que o nome desse sujeito é INDETERMINADO, isto é, o sujeito existe, mas não se quer determiná-lo na redação jurídica.
Enfim, compreendida essa ideia, vamos ver exemplos de sujeito indeterminado, leiam atentamente a seguinte construção:
“Trata-se de agravo de instrumento interposto pelo Banco do Brasil contra João da Silva.

Notem que a estrutura começa com sujeito indeterminado (“Trata-se de”).
Além do mais, quando é assim, não podemos, logo após, trazer um sujeito oculto (no caso “o agravante”, em “o agravante alega”).
Por isso, só há espaço para sujeito oculto se o sujeito aparecer expressamente antes no texto, o que não ocorre aqui, já que, repito, o sujeito da frase anterior é indeterminado.
Então, para resolver o problema, basta redigir o texto desta forma:
“Trata-se de agravo de instrumento interposto…
O AGRAVANTE alega que não estão presentes…”.
Aliás, outro erro cometido em peças por não se saber identificar esta questão é o seguinte:
“Cuida-se o caso de ação anulatória ajuizada…”
