O uso da vírgula no texto jurídico
Hoje quero passar para vocês duas ótimas regras sobre vírgula para não errar mais. Vamos lá?
A primeira regra, apesar de simples assimilação, costumamos errar bastante:
NÃO HÁ VÍRGULA ENTRE SUJEITO E PREDICADO, MESMO QUE O PERÍODO ESTEJA INVERTIDO. Veja:
“O mesmo decreto que fixou sua remuneração, estabeleceu a política de atualização desse valor”
(Errado – “O mesmo decreto que fixou sua remuneração” é sujeito do predicado “estabeleceu a política de atualização desse valor”. Sem vírgula, portanto).
“O art. 151, I, da Carta Magna, adverte…” (Errado – sem vírgula depois de “Magna”).
“Funcionou como representante do Ministério Público, o Exmo. Sr. …”
(Errado – “o Exmo. Sr. …” é sujeito do predicado “funcionou como representante do Ministério Público”).
A segunda e valiosa regra sobre o uso da vírgula é: VIRGULE PARA INTERROMPER A FLUÊNCIA (NORMALIDADE) DA ORAÇÃO.
Observe a seguinte frase:

“Alega que o prazo prescricional ainda não havia encerrado”.
Se formos interromper essa frase, que flui normalmente, colocamos entre vírgulas a informação que a interrompe:

“Alega que, na data do ajuizamento da ação, o prazo prescricional ainda não havia encerrado” (Certo).
Ainda sobre o caso acima, existe uma regra muito, mas muito boa: OU SE COLOCAM AS DUAS VÍRGULAS, OU NÃO SE COLOCA NENHUMA. Veja:

“Alega que, na data do ajuizamento da ação, o prazo prescricional ainda não havia encerrado” (Certo – duas vírgulas).

“Alega que na data do ajuizamento da ação o prazo prescricional ainda não havia encerrado” (Certo – nenhuma vírgula).
-
“Alega que na data do ajuizamento da ação, o prazo prescricional ainda não havia encerrado” (Errado – apenas uma vírgula).
-
“Alega que, na data do ajuizamento da ação o prazo prescricional ainda não havia encerrado” (Errado – apenas uma vírgula).
Note que essa regra se aplica bem em estruturas com a conjunção integrante “que” (alega que, constata-se que, afirma que, a leitura da cláusula revela que).
