Surpresos com essa afirmação? Mas é isso mesmo: quando não existe pausa, não existe vírgula.
Vejam as seguintes construções, corretamente virguladas:
“Contudo, na impossibilidade de devolução do bem, deve o banco depositar a quantia…” (há pausa e vírgula depois de “contudo” e “bem”).
“Nas obrigações provenientes de ato ilícito, considera-se o devedor em mora desde que o praticou” (idem; há pausa e vírgula depois de “ilícito”).
“Ademais, sem parcelamento regular não é possível abrir a matrícula, e, sem a matrícula, a sentença que venha a deferir o usucapião não pode ser registrada” (idem em todas as ocorrências de vírgula).
ATENÇÃO: Dizer que “se não há pausa, não há vírgula” NÃO SIGNIFICA que sempre que houver pausa haverá vírgula. São coisas diferentes!!
Observem estas construções, também corretamente virguladas:
“O art. 173, § 2º, da Carta Magna adverte…” (não há vírgula depois de “Magna”, apesar da pausa na leitura. A vírgula aí separaria sujeito de predicado, o que não é permitido).
“Funcionou como representante do Ministério Público o Exmo. Sr. …” (novamente: apesar da pausa na leitura, não há vírgula depois de “Público”, pois também separaria sujeito de predicado).
“Do Superior Tribunal de Justiça colhe-se:” (vejam que há pausa depois de “Justiça”, mas a vírgula aí estaria errada, pois separaria o verbo (colher) do seu complemento (Do Superior Tribunal de Justiça), o que igualmente não é permitido).
Há até casos em que existe a pausa, a vírgula seria possível, mas não é usada por ser desnecessária ou porque a clareza não a pede.
Analisemos a frase anteriormente transcrita:
“Ademais, sem parcelamento regular não é possível abrir a matrícula, e, sem a matrícula, a sentença que venha a deferir o usucapião não pode ser registrada”.
Notem que há pausa depois de “regular” e que a vírgula aí não estaria incorreta, mas optou-se pelo não emprego dela por ser desnecessária e porque o texto ficaria “poluído” de vírgulas.
