Notem que a frase expressa obrigatoriedade e poderia ser escrita assim: “O autor DEVE demonstrar o fato constitutivo do seu direito”.
Nesse sentido alguns gramáticos puristas lecionam que o correto seria o uso do “de” (o autor tem DE demonstrar), não do “que”.
Eu até prefiro com o “de” mesmo, MAS SÃO ACEITAS AMBAS AS FORMAS (ter de ou ter que) para indicar obrigatoriedade:
“O autor tem DE demonstrar o fato constitutivo do seu direito” (Certo).
“O autor tem QUE demonstrar…” (Certo).
Uma dica que dou pra vocês é: quando já existir na frase outro “de” ou “que”, usar a outra forma para evitar repetição. Assim:
“Os adquirentes dos imóveis depositaram em juízo a quantia que tinham DE pagar à construtora” (como já há um “que” depois de “quantia”, é preferível o “de” para evitar a repetição).
“De fato, os embargantes tinham QUE provar a existência de omissão na sentença” (nesse caso, já há dois “de” na construção, então o “que” é recomendado).
À exceção desses casos (para evitar repetição), pode-se usar, indiferentemente, a expressão “ter que” ou “ter de”.
