Classes processuais na redação jurídica
Entende-se por “classe processual” o nome dado a ações e recursos: “ação de compensação por dano moral”, “ação de busca e apreensão”, “execução fiscal”, “apelação cível”, “embargos de declaração”, “recurso especial” etc.
Em primeiro lugar, se você fizer referência à classe processual desacompanhada do número, nunca, eu disse nunca, use-a com iniciais maiúsculas!
Isso é feio, prejudica a leitura, irrita o leitor, enche o saco dele. Portanto, escreva:
“Trata-se de apelação cível interposta da sentença proferida…” (e não: “Trata-se de Apelação Cível…”).
Se a classe processual estiver numerada, daí, sim, coloque as iniciais maiúsculas. Assim:
“Trata-se da Apelação Cível n. 2017.243434-2…”.
Sempre coloque a abreviatura “n.” entre a classe processual e o seu número.
Quando forem citados dois ou mais processos da mesma classe, não repita a abreviatura:
“Apelações Cíveis n. 2005.2003-8, n. 2005.658888-4 e n. 2006.365567-0.” (errado)
“Apelações Cíveis n. 2005.2003-8, 2005.658888-4 e 2006.365567-0.” (certo)
As siglas e abreviaturas das classes processuais não têm forma pluralizada:
“Extrai-se das ementas dos AI n. 2006.363359-7 e 2006.789638-9…” (e não: “AIs”).
Por falar em agravo de instrumento, a forma correta no plural é “agravos de instrumento”, não “agravos de instrumentoS”! Já vi escrito assim.
Lembre-se de que “habeas corpus” é expressão latina. Escreva-a, portanto, em itálico, mesmo se acompanhada do número.
Por ser esteticamente feio, não use a sigla da classe processual sozinha, sem o número:
“Cuida-se de HC impetrado…” (errado).
Há quem goste de dar nomes diferentes para as classes processuais (ação injuntiva, ação executória, embargos declaratórios (o correto é embargos de declaração), ação cominatória, embargos monitórios, recurso extremo).
