Aliás, acho que não deve haver nada melhor para um advogado do que, citado para contestar, se deparar com uma petição inicial pouco articulada, em que pedido e causa de pedir são expostos de forma obscura ou prolixa, em que o idioma vem escrito de maneira capenga, com problemas de toda ordem, gramatical, de estilo e de clareza.
Mesmo que o advogado tenha bons argumentos, eles dificilmente subsistirão se a peça estiver mal-escrita.
Se eu, como advogado, tenho em mãos uma petição inicial capenga na linguagem e cujos argumentos devo contestar, uma das minhas primeiras armas
retóricas será desqualificar, de forma educada, claro, a escrita do meu oponente, com frases do tipo:
“Se é esse mesmo o pedido do autor, pois, da forma obscura como foi feito, é difícil compreendê-lo,…”, “Ora, esses são fundamentos que, se bem os entendeu o réu, não podem ser levados em consideração por Vossa Excelência”,
“Em relação ao dano moral, não se consegue, por mais esforço que se possa fazer, enxergá-lo dos termos da petição inicial, em que o autor mistura fatos e não faz adequada relação entre eles e o dano que diz ter sofrido”.
Imaginem o impacto que essas minhas frases, na contestação, terá sobre o juiz, que a essa altura também já leu a petição inicial e tem ciência de que está mal redigida! É quase causa ganha! E reparem que nem estou rebatendo ainda o mérito em si da demanda; meu ataque está sendo apenas no plano formal, no plano da escrita.
Falando em juiz, também acredito que, para ele, receber uma petição inicial “problemática” é um tanto mais cômodo do que uma petição bem redigida, que
sempre exigirá dele argumentos sólidos, seja para julgar procedente ou improcedente a pretensão deduzida.
Um petição malfeita, por outro lado, certamente não receberá a mesma atenção, não terá o poder de modificar o entendimento, mais ou menos já formado, do juiz a respeito da matéria trazida a julgamento.
