A vírgula depois de “autora” está errada. É assustadora a quantidade de vezes que encontro erros desse tipo em peças jurídicas.
Por isso que, embora eu já tenha falado muito aqui sobre a vírgula, o post de hoje é mais uma vez dedicado a ela.
Sabem por que muitos insistem em colocar aquela vírgula depois de “autora”?
Porque pensam que a pausa na leitura sempre acarreta a vírgula.
Não. Ainda que, como já disse em outro post, a vírgula sempre exigirá a pausa na leitura (à exceção de vocativos como “sim, senhor”), a pausa na leitura nem sempre pedirá a vírgula.
Saber empregar a vírgula tem muito a ver com entender a relação sintática dos termos da oração.
Conforme ensina o professor Napoleão Mendes de Almeida, termos com ÍNTIMA RELAÇÃO SINTÁTICA não podem vir separados por vírgula.
Quando sei, por exemplo, que o complemento do verbo é com este intimamente ligado, jamais colocarei a vírgula depois de “ré” na oração “ao recurso interposto pela ré o magistrado concedeu efeito suspensivo”, pois “ao recurso interposto pela ré” é objeto indireto (complemento) do verbo “concedeu”.
Da mesma forma, e partindo para a frase inicialmente apresentada, aquela vírgula depois de “autora” está errada porque separa o verbo do seu complemento.
No caso, separa o verbo “pleiteia” do seu objeto direto (“a declaração de impenhorabilidade do imóvel”).
Correta, a frase é redigida assim:
“Pleiteia, em suma, a autora a declaração de impenhorabilidade do imóvel”.
É interessante que, se a expressão “em suma” fosse excluída da frase, não teríamos dúvida sobre o NÃO emprego da vírgula depois de “autora”.
Isso porque com a exclusão a pausa na leitura não é exigida. Vejam:
