Ação contra ou ação em face? Como escrever?
Nos comentários de um post em que defendi que o correto é escrever “ação CONTRA”, e não “ação EM FACE DE”, seguidor me perguntou se, em se tratando de denúncia, também devemos escrever “oferecer denúncia CONTRA”.
A pergunta é interessante, porque, se pararmos para pensar, o Ministério Público oferece denúncia mas não é o titular da relação de direito material discutida.

Representando o Estado, o MP nada mais faz (falando de forma bem simplória) do que provocar, na ação penal pública, a atividade jurisdicional.
Em outras palavras, o “Parquet” oferece denúncia não necessariamente para ver a condenação do acusado, mas porque é obrigado por lei a tanto desde que o Estado, representado por ele, passou a proibir a solução privada de conflitos (Eugênio Pacelli).
Mas ainda que o MP não seja o titular da relação de direito material, é ele titular da ação penal pública.
Nesse sentido, quando oferece denúncia está ajuizando uma ação, e a palavra “ação” pede, como vimos naquele outro post, a preposição “contra” (ação contra alguém).
Está corretíssimo, portanto, também escrever “oferecer denúncia CONTRA”.
Tá, eu sei, a explicação acima está parecendo um sofisma.
Mas não é, não. Segue a mesma lógica. Todavia, para não restar dúvida, vamos ao Dicionário de Regência Nominal, do Pedro Luft, no qual constatamos que o nome “denúncia” pede mesmo a preposição “contra” (“denúncias contra personalidades públicas”).
