Lembrei-me, então, daquele post sobre a vírgula antes de ‘e sim’, ‘e não’ e ‘mas, sim,’.
A regra também se aplica a esse trecho: ‘[…] pode sim embasar a condenação […]’?
Ou seja, o sim deve estar entre vírgulas?
Porque aqui quero reforçar a afirmação, e não a negação. Grato!”.

Sem dúvidas eu colocaria aquele “sim” entre vírgulas.
É bem verdade que se não empregarmos as vírgulas não haverá prejuízo em nível sintático (a ordem das palavras na frase continuará sendo lógica), nem em nível semântico (compreenderemos tranquilamente o que se quer dizer).
Ocorre que, quando escrevemos uma peça jurídica, devemos persuadir o leitor, devemos dar um “plus” ao texto.
Nesse sentido, notem que colocar o “sim” entre vírgulas na estrutura apresentada pelo seguidor confere, como ele mesmo disse, reforço na afirmação de que a confissão extrajudicial pode embasar a condenação do agente criminoso.
Aliás, vou aproveitar o gancho para sugerir que quando vocês quiserem reforçar uma palavra, expressão ou frase no texto, coloquem-na, sempre, entre vírgulas, tal como fiz agora com o “sempre”. (É impressionante como dicas assim, tão simples, podem tornar nossas peças muito mais agradáveis e argumentativas!)

Apenas meio que por uma questão de lealdade, devo dizer que o seguidor, logo após fazer a pergunta, disse que para ele o “sim” deveria vir entre vírgulas.
