O mau emprego do gerúndio
O mau emprego do gerúndio nos textos jurídicos é assustadoramente recorrente.
Isso ocorre em razão da falta de conhecimento, por parte do operador do direito, de outros recursos linguísticos para desenvolver seu texto.
O gerúndio, principalmente nos textos jurídicos, é um verdadeiro “quebra-galho” gramatical. Vejam, por exemplo, a seguinte frase:
“A prova acusatória, portanto, é completa, não tendo sido ilidida pelo acusado, sendo certo que ficou patente que sua ação abarcou ambos os elementos da denunciação caluniosa”.
Observem que os gerúndios, utilizados incorretamente, causam ambiguidade, a ponto de provocarem irritação no leitor pela incompreensão textual. Então cuidado!
Corrigida, a frase fica assim:
“A prova acusatória, portanto, é completa, e não foi ilidida pelo acusado, de forma que ficou patente que sua ação abarcou ambos os elementos da denunciação caluniosa”.
