Creio que essa confusão ocorre por analogia aos vocábulos “evidente” e “patente”, parecidos que são com aquela palavra na pronúncia e escrita.
Então cuidado com o uso da palavra, principalmente os que atuam na área criminal, que adoram usar essa palavra nas peças (constatei isso ao pesquisar frases para trazer de exemplos).
