“… sentença que julgou procedente o pedido” – Quem julga é a sentença ou o juiz?
Vejam a seguinte construção:
“Carlos da Silva interpôs apelação da sentença que julgou procedente o pedido de compensação por dano moral”.
Já ouvi uns tantos dizendo que há aí um erro, pois “sentença” não julga ninguém; quem julga é o juiz.
Para esses, pelo mesmo motivo estaria incorreta a frase “Trata-se de agravo de instrumento contra a DECISÃO que indeferiu o pedido de gratuidade da justiça feito pelo autor”.
Não, gente, não há nada de errado nessas construções! “Sentença” e “decisão” nesses contextos são uma figura de linguagem denominada “metonímia”.
Estão no lugar de “juiz” (“juiz” que julgou, “juiz” que indeferiu).
Aliás, usamos de metonímia o tempo todo nas nossas peças e nem nos damos conta. Observem, por exemplo, as frases:
“Colhe-se da JURISPRUDÊNCIA deste TRIBUNAL”.
Geralmente empregamos o termo “jurisprudência” como metonímia, fazendo referência a duas ou três decisões, e não a um conjunto de julgados no mesmo sentido; “tribunal” está sendo também usado metonimicamente, referindo-se a apenas um dos seus órgãos fracionários, não a todo o tribunal.
“Dessa decisão o JUÍZO A QUO não se retratou”.
Sabemos que “juízo a quo” não pode se retratar; a expressão está também substituindo “juiz”.
“Para receber o benefício da gratuidade da justiça, o POSTULANTE deve comprovar hipossuficiência”.
Todos os postulantes devem fazer isso, não apenas um; “postulante” é, portanto, uma metonímia.
E reparem neste último exemplo: “Inconformado, o AUTOR interpôs recurso especial”.
Muitas vezes usamos as palavras “autor”, “réu”, “apelante”, “recorrido”, “agravado” etc. de forma metonímica, no lugar de “procurador/advogado”, que é quem de fato, na maioria dos casos, faz alegações nos autos e interpõe recursos.
